These Advertising Terms govern the relationship between Dmytro Bezrukov, Tachora — sole proprietorship, Neue Grabenstraße 24, 32657 Lemgo, Germany ("Tachora") and the advertiser when paid advertising space is booked in the TachoPlus app or on the Tachora website. They supplement the Terms of Service and apply exclusively to businesses within the meaning of § 14 BGB. The German version is legally binding.

§ 1 Offer and conclusion of contract

Binding ad bookings come into effect upon order confirmation in text form. Tachora may refuse orders without giving reasons.

§ 2 Permitted advertising categories

Products and services for professional drivers and logistics companies.
Job advertisements, employer branding, training offers.
Vehicle, workshop and insurance offerings.
Traffic- and toll-related software and hardware.
Mobility- and travel-related services.

§ 3 Prohibited content

The following content is not accepted, or will be removed afterwards:

unlawful, immoral, violent, pornographic, racist, discriminatory or anti-constitutional content;
misleading or unfair advertising within the meaning of the UWG;
gambling without a permit under German law;
medical promises without proper evidence;
content that violates third-party rights (trademarks, copyright, personal rights);
direct competing products to Tachora's core services without prior written agreement.

§ 4 Advertiser's responsibility

The advertiser is solely responsible for the content of the advertising, including texts, images, logos, trademarks, links and factual statements. By placing the order the advertiser warrants that it holds the necessary rights and indemnifies Tachora against third-party claims arising from the advertising.

§ 5 Review and rejection by Tachora

Tachora may review advertising material before publication and reject or remove it for objective reasons, in particular if the requirements of §§ 2 and 3 are not met. There is no obligation to pre-screen content.

§ 6 Delivery, duration and placement

The campaign starts on the date confirmed in the order.
Where a specific placement (e.g. "VIP", "Featured", specific slots) is booked, Tachora will implement it within technical possibilities. Other placements are delivered equally according to the internal slot algorithm.
Tachora gives no guarantee regarding specific impressions, clicks, conversions, hires or downloads. Agreed performance KPIs apply only if individually confirmed in text form.

§ 7 Fees, due dates and payment

Prices follow from the offer or the pricing page.
Invoicing takes place at the start of the campaign unless expressly agreed otherwise.
Payment term: 14 days from invoice date, unless otherwise agreed.
Late payment triggers statutory interest and dunning costs (§ 288 BGB).

§ 8 Cancellation

Cancellation before campaign start: free of charge if notice reaches Tachora at least 5 business days before the planned start date.
Cancellation less than 5 business days before start: 50 % of the booked order volume as expense compensation.
Cancellation after start: no refund for already delivered advertising. The remaining period may be cancelled pro rata; any granted discounts expire pro rata.

§ 9 Technical availability

Tachora strives for continuous delivery. Short-term technical outages do not give rise to refund claims provided they do not materially impair the agreed advertising volume (e.g. less than 10 % of the agreed runtime).

§ 10 Liability

Tachora's liability is governed by § 13 of the Terms of Service. The advertiser alone is liable for damages caused by incorrect or impermissible advertising content.

§ 11 Data protection

Advertising is delivered without personal profiling or cross-site tracking. Anonymised impression and click data are stored for billing purposes; details in the Privacy Policy, section 3.7.

§ 12 Governing law / jurisdiction

German law applies. Place of jurisdiction for disputes arising from advertising orders with businesses is Lemgo.
